These Terms and Conditions (“Terms”) govern the access to and use of the My Glamour website and mobile application (collectively, the “Platform”), operated by Bookursalon Private Limited, a company incorporated under the Companies Act, 2013, having its registered office at 2-55/22 & 23, Sri Rama Colony, Guttalabegumpet, Madhapur, Hyderabad, Telangana – 500081, India (“My Glamour”, “Company”, “we”, “us”, or “our”).

By accessing, browsing, registering, or transacting on the Platform, you (“User”, “you”, “your”) agree to be bound by these Terms, the Privacy Policy, and all policies incorporated by reference. If you do not agree, you must not use the Platform.

1. NATURE OF PLATFORM

1.1 My Glamour is an online marketplace that enables independent third-party sellers (“Sellers”) to list and sell beauty, personal care, cosmetic, skincare, haircare, grooming, and allied products (“Products”) to users (“Buyers”).

1.2 My Glamour is not a seller, distributor, stockist, agent, or manufacturer of Products, and does not control, own, or guarantee the quality, safety, legality, or availability of Products listed on the Platform.

1.3 All contracts of sale are strictly between the Buyer and the Seller. My Glamour acts solely as a technology intermediary as defined under the Information Technology Act, 2000.

2. ELIGIBILITY & ACCOUNT REGISTRATION

2.1 You must:

• Be at least 18 years of age, or use the Platform under parental/guardian supervision.

• Be competent to contract under the Indian Contract Act, 1872.

2.2 Account registration requires accurate and complete information, including a valid email address and mobile number.

2.3 Business users and Sellers represent that they have authority to bind the entity they represent.

2.4 You are responsible for maintaining confidentiality of your login credentials. Any activity conducted through your account shall be deemed authorized by you.

2.5 My Glamour reserves the right to suspend, restrict, or terminate accounts for violations, suspected fraud, or regulatory non-compliance, without prior notice.

3. USER OBLIGATIONS

3.1 Buyer Obligations

Buyers agree to:

• Review product descriptions, pricing, and Seller policies before purchase.

• Provide accurate delivery and contact details.

• Make lawful payments through approved payment methods.

• Not misuse return, refund, or grievance mechanisms.

• Not engage in fraudulent, abusive, or manipulative conduct.

Certain Products may require age verification (18+).

3.2 Seller Obligations

Sellers must:

• Enter into a separate Seller Agreement with My Glamour.

• List only genuine, lawful, non-expired, and non-counterfeit Products.

• Comply with all applicable Indian laws including:

  • Drugs and Cosmetics Act, 1940

  • Legal Metrology Act, 2009

  • Bureau of Indian Standards (BIS) requirements

  • Consumer Protection (E-Commerce) Rules, 2020

• Display accurate product descriptions, images, pricing (inclusive of GST), and return policies.

• Issue valid GST invoices and maintain tax compliance.

• Fulfil orders within committed timelines and maintain minimum performance metrics.

4. ORDERS, PRICING & PAYMENTS

4.1 An order placed by a Buyer constitutes an offer to purchase. Acceptance occurs only upon confirmation by the Seller.

4.2 Payments are processed in Indian Rupees (INR) through RBI-approved payment gateways (UPI, cards, net banking, wallets).

4.3 My Glamour collects payments on behalf of Sellers and remits the same after deducting:

• Marketplace commission (generally 5%–15%)

• Payment gateway charges

• Applicable taxes or deductions

4.4 Prices displayed are inclusive of GST unless stated otherwise.

5. SHIPPING & DELIVERY

5.1 Sellers are responsible for shipping Products through approved logistics partners.

5.2 Delivery timelines are indicative only. Delays caused by logistics providers, force majeure events, or regulatory restrictions are beyond My Glamour’s control.

5.3 Risk of loss passes to the Buyer upon delivery.

6. RETURNS, REFUNDS & CANCELLATIONS

6.1 Returns are governed by Seller-specific return policies, subject to Platform standards. No return is accepted unless and untill it is a wrong/expired/damage product delivered

6.2 Typical return window:

• 7 days for most Products

• 30 days for unopened skincare items

• No returns for opened, used, hygiene-sensitive, or personalized Products

6.3 Refunds are processed to the original payment method within 5–7 business days after return verification.

6.4 My Glamour may facilitate dispute resolution but cannot compel a Seller to accept a return or refund.

7. INTELLECTUAL PROPERTY

7.1 All Platform content including My Glamour logo, UI, design elements, and software are owned or licensed by My Glamour.

7.2 Sellers/Product manufacturers retain ownership of product images, trademarks, logos, and listing materials provided by them or their brands.
My Glamour claims no ownership over such materials and acts solely as a hosting intermediary.

7.3 Trademark misuse or IP infringement may be reported to info@myglamour.in and will be addressed through a notice-and-takedown mechanism.

8. REPRESENTATIONS, DISCLAIMERS & LIMITATION OF LIABILITY

8.1 The Platform is provided on an “as-is” and “as-available” basis.

8.2 My Glamour disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

8.3 My Glamour shall not be liable for:

• Product quality, safety, or efficacy

• Seller conduct or omissions

• Indirect, incidental, or consequential damages

8.4 Maximum liability, if any, shall be limited to the transaction value or INR 10,000, whichever is lower.

9. INDEMNITY

The User/Seller agree to indemnify and hold harmless My Glamour, its directors, officers, employees, and affiliates from all claims, losses, damages, and expenses arising out of:

• Breach of these Terms

• Violation of applicable laws

• Infringement of third-party rights

10. TERMINATION

My Glamour may suspend or terminate access to the Platform at its discretion for violations or legal requirements. Provisions relating to liability, indemnity, dispute resolution, and governing law shall survive termination.

11. DISPUTE RESOLUTION

11.1 Parties shall first attempt amicable resolution.

11.2 Failing which, disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996.

No class or representative actions permitted.

12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India. Courts at Hyderabad, Telangana, shall have exclusive jurisdiction, subject to arbitration provisions.

13. MISCELLANEOUS

• Severability: Invalid provisions shall not affect enforceability of remaining Terms.

• Force Majeure: No liability for events beyond reasonable control.

• Entire Agreement: These Terms constitute the entire agreement between parties

Governing Law and Exclusive Jurisdiction

This Policy and all transactions, communications, and contractual relationships arising out of or in connection with the use of the Platform shall be governed by and construed exclusively in accordance with the laws of India. The courts at Hyderabad, Telangana, shall have sole and exclusive jurisdiction over all disputes, claims, or proceedings arising out of or relating to this Policy, the Platform, or any transactions conducted thereon, to the exclusion of all other courts.
 

Dispute Resolution and Arbitration

In the event of any dispute, controversy, or claim arising out of or in connection with this Policy, the Platform, or any transaction conducted on the Platform (“Dispute”), the parties shall first attempt to resolve the Dispute amicably through good-faith negotiations within thirty (30) days from the date on which such Dispute is formally notified by one party to the other.

If the Dispute is not resolved through amicable discussions within the aforesaid period, the Dispute shall be referred to and finally resolved by arbitration in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.

The arbitration shall be conducted by a sole arbitrator appointed by My Glamour. The seat and venue of arbitration shall be Hyderabad, Telangana, and the arbitration proceedings shall be conducted in the English language.

The arbitral award shall be final, binding, and enforceable on the parties. Subject to the foregoing, the courts at Hyderabad, Telangana, shall have exclusive jurisdiction over all matters arising out of or in relation to the arbitration proceedings, including enforcement of the arbitral award.

Nothing in this clause shall prevent My Glamour from seeking interim or injunctive relief from a court of competent jurisdiction at Hyderabad, Telangana, in accordance with applicable law.
